Crush Check Terms of Service

These Terms of Service ("Terms") govern your use of Crush Check, an app provided by Eponymical Games Ltd ("we", "us", "our").

1. About us

Eponymical Games Ltd is a private limited company registered in England and Wales, based at 86-90 Paul Street, London, EC2A 4NE, United Kingdom. Contact: direct@eponymicalgames.com.

2. Acceptance

By using Crush Check, you agree to these Terms. If you do not agree, do not use the app.

3. Age eligibility

Crush Check is available only to users aged 13 or older. On first launch, you must select your age range honestly. The app does not request your date of birth, and users who select under 13 cannot proceed into the app.

4. Entertainment use only

The app creates playful red or green flag results from photos, chat screenshots and other images you choose or take. Results are jokes generated for entertainment. They are not personality analysis, relationship advice, health advice, safety advice, psychological advice, identity verification, biometric identification or any other professional advice.

5. Your photos and conduct

You are responsible for the photos you use with the app and for complying with applicable law. Do not use the app to harass, shame, discriminate against, profile, make consequential decisions about or otherwise harm another person.

6. Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to use Crush Check for your own personal entertainment. We reserve all rights not expressly granted to you.

7. Sharing

If you share a generated result, you are responsible for where and how you share it. The destination app or service you choose may apply its own terms and policies.

8. Prohibited uses

• Do not use the app for unlawful, harmful, discriminatory, abusive or deceptive purposes.
• Do not use the app to make serious or consequential decisions about another person.
• Do not reverse-engineer, copy, resell, sublicense or attempt to extract source code or proprietary assets except where the law does not allow us to prohibit it.
• Do not interfere with, disrupt or attempt to gain unauthorised access to the app or related systems.

9. Advertising and Remove Ads

The app may display banner and interstitial advertising supplied through Google Mobile Ads (AdMob). Advertising availability and content may vary. The optional one-time Remove Ads in-app purchase removes those ads from the app on supported devices and can be restored through the same app-store account. It does not remove or change content outside Crush Check.

10. App store terms and purchases

If you download the app from the Apple App Store, Google Play or another app store, your use is also subject to that store's terms, payment rules and refund rules. The store processes the Remove Ads purchase. Prices are displayed by the store before confirmation, and applicable store payment, family sharing, restoration and refund rules control the transaction. We do not process payment-card or bank-account details.

11. Privacy

Our Crush Check Privacy Policy explains the local age-range selection and Google's under-age-of-consent treatment flag, local photo and chat processing, limited Google ML Kit operational telemetry, Google Mobile Ads, UMP privacy choices and store purchase information.

12. Beta availability

TestFlight builds, previews and beta versions are provided "as is", may contain bugs, may be incomplete, may change significantly and may be withdrawn at any time.

13. Disclaimers

The app is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose, non-infringement, availability, uninterrupted operation and error-free results.

14. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so. Subject to that, and to the maximum extent permitted by law, Eponymical Games and its owners, officers, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost data, loss of goodwill or claims arising from your use of photos or generated results.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date above.

16. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where mandatory consumer laws give you additional rights or allow you to bring a claim in another jurisdiction.
